Abstract

The relationships between society and its condition of subordination to the state and how the latter exercise its power over it, corresponds to a historical debate that has left us with different models of relationship between man and state power, where the freedoms of the former and the second's obligations are a constant object of confrontation. In this understanding and placing ourselves in the contemporary framework which has been marked by different historical social dynamisms, we find ourselves with the dilemma about the limits of state influence on individuals in the framework of a pandemic that led to a State of exception and different social struggles rooted in it for the defense of basic rights. It is because of the above that this work seeks to highlight constitutional guidelines and international systems that guarantee the protection of human dignity in different crisis contexts to provide a holistic view of the importance of a legal, legal and social nature of the protection of human rights. rights and freedoms against the power of the State in our times that guide the social course from the institutional and legal channels against abuses and excesses of public powers.Undoubtedly, the pandemic generated an unprecedented situation in which we were affected absolutely each and every one of the human activities, which regardless of the social or economic condition we are threatened, where the resolutions by the government to deal with, have consequently been without precedents and out of the ordinary.
