Underage worker: Reality or social pathology. perspective of the Colombian legal system

Abstract

Child labor has been a topic addressed multiple times by academics, activists, politicians and, in general, people and institutions concerned about this social problem. Although it seems to be a subject that has been fully addressed, the truth is that it has complex characteristics in terms of its origin and permanence over time. Hence, it is an issue that must continue to be addressed in all its aspects, always seeking to protect and guarantee the rights of children and adolescents in Colombia and the world. This investigative article is aimed at establishing the theoretical-normative and jurisprudential framework of child labor in Colombia, as well as the analysis of the project "Prevention and Eradication of Child Labor and its Worst Forms" of the District Mayor's Office of Barranquilla. The importance of this investigative article lies in determining the position that Colombia assumes regarding child labor and the observance of the management carried out by the institutions and authorities in the matter, determining its operating mode and current information on its operation.

This research is socio-legal, the paradigm is historical-hermeneutical with a qualitative approach, inductive method, descriptive and as a research technique and instrument, a jurisprudential and documentary analysis will be carried out. As a result, the Colombian state adheres to the international position of the abolitionist current where the eradication of child labor prevails in accordance with ratified international treaties and pronouncements issued by the Constitutional Court.
