Abstract

The power that crime has been obtaining transnationally has generally been due to its way of operating, that is, the means it uses, and above all, by those who work within it, covering political, economic and social sectors.  The factors that are often rooted in the genesis of the criminal phenomenon increasingly invade more vulnerable social groups, in order to recruit, victimize or train them in favor of criminal organizations. Juvenile or adolescent delinquency in conflict with the law is a phenomenon that increases as the progress of our society.  Given this, corrective measures should be put to this problem;  But it is important to mention that to attack the problem it will be necessary to study the risk factors that favor it, as well as the motivations or circumstances that lead the minor to adopt these behaviors.To understand the consequences that the participation of minors in organized crime would have in Mexico and Colombia during the period 2019-2020, aspects are analyzed from a historical hermeneutical research paradigm, with a qualitative approach, based on an inductive research method in relation to  a descriptive investigation and with this, frameworks are determined such as: Contextualization of the problem, Children and adolescents in contexts of insecurity and violence, Legal framework applicable to the protection of children against all forms of violence. The present work has the purpose of investigating which is the role that minors play when they belong to a criminal group of any kind, therefore it will be important to mention some hypotheses from other authors that we will take as support when explaining and contrasting this position.  On the other hand, it will seek to provide a solution where crime stops choosing to resort to minors trying to eliminate those circumstances that make them vulnerable.
