The objective of this article is to analyze the jurisprudential criteria used by the Court Constitutional and the Supreme Court of Justice in the protection of the Reinforced Labor Stability in Workers with Disabilities The methodology used is descriptive and qualitative, they are inscribed in the Hermeneutical Method that understands and interprets phenomena, behaviors or normative elements, the technique is the analysis The results obtained are based on the positions of the both courts in recent sentences, with respect to the subject in question, and the conclusion reached is the dissimilar positions which are contradictory with respect to the broad concept of disability for each of the courts and the conditions given by means of percentages required for it to be demonstrated.
